Draft. Hauspot is in testing. Fields in square brackets will be completed before launch. This text needs a lawyer's review before publication.
§1. Definitions
- Operator - [operator name], [address], [tax / company register number], who runs Hauspot.
- Hauspot - the service in which dog owners find pet-friendly places: the mobile app and the website.
- Business Panel - the part of the Hauspot website in which a Business manages its Venues.
- Business - an entrepreneur who has created a Business Account in the Panel, or a person acting on their behalf.
- Business Account - an account in the Business Panel.
- Venue - a place run by a Business (e.g. a café or a restaurant), described in the Panel.
- Verification - the Operator's check of a Venue's information before it is shown in Hauspot.
- Users - people who use the Hauspot app.
§2. General provisions
- These Terms set out the rules for using the Business Panel and for showing Venues in Hauspot.
- Creating a Business Account requires accepting these Terms and the Privacy Policy.
- The Panel is intended for entrepreneurs. By creating a Business Account, the Business declares that it acts in connection with its business activity.
- Contact with the Operator: kontakt@hauspot.pl.
- Using the Panel requires a device with internet access, an up-to-date browser and an email address.
§3. Business Account
- A Business creates a Business Account by giving an email address and a password, and then the contact person's full name and a phone number.
- The email address must be confirmed. Without confirmation, a Venue cannot be sent for Verification.
- The Operator may create a Business Account on a Business's behalf, e.g. after talking to it. The Business then receives an email with a link to set a password and accepts these Terms at its first sign-in.
- One Business Account can manage many Venues. Each Venue has one Business Account.
- The Business keeps its password confidential and is responsible for actions taken from its Account.
- The Business may delete its Business Account at any time. Its Venues are then hidden, and drafts never sent are deleted.
§4. Adding a Venue
- The Business describes the Venue in the Panel: its name, type, address and position on the map, opening hours, logo and - if it wishes - a description, photos, contact details, cuisines, price range and menu.
- The most important part of the description is what a dog gets: water, a meal, a chew, a treat. It must match what the Venue really offers.
- A Venue can be sent for Verification when it has a logo, opening hours for every day and a position on the map, and the Account's email address is confirmed.
- The Business declares that:
- it is entitled to represent the Venue;
- the Venue's information is true and up to date;
- it holds the rights to the content it uploads - logo, photos, descriptions, menu - and publishing it does not infringe third parties' rights.
- The Business grants the Operator a royalty-free, non-exclusive licence to display, crop and resize the uploaded content in Hauspot - in the app, on the website and in materials promoting Hauspot - for as long as the Venue is shown and to the extent needed to run the service.
- Unlawful or misleading content, offensive content and advertising unrelated to the Venue are prohibited.
§5. Verification and publication
- Nothing a Business adds or changes is visible in Hauspot before the Operator approves it - except the quick changes in §6(2).
- The Operator verifies the information as it sees fit - e.g. by phone, by email or by visiting the Venue.
- The Operator approves or rejects a submission. A rejection includes the reason; the Business may correct the information and send the Venue again.
- The Business learns of the decision by email and in the Panel.
- Once the Operator starts a Verification, the submission is locked until the decision.
- The Operator makes every effort to verify submissions without undue delay but does not guarantee a time frame.
§6. Changes to a Venue's information
- The Business may change a published Venue's information in the Panel. The changes wait for Verification, and until the decision Users see the previous information.
- Quick changes - opening hours, price range, and the prices and availability of menu items - are visible at once, without Verification, even while another change is being verified.
- The Business is responsible for keeping the information up to date, in particular the opening hours and what a dog gets.
- Every version of a Venue's information is kept in its history of changes.
§7. Withdrawing a Venue
- The Business may withdraw a Venue from Hauspot at any time. It disappears at once, without the Operator's approval.
- A withdrawn Venue can be restored by sending it for Verification again.
§8. User reviews
- Users may rate Venues and add reviews.
- The Business may not delete or edit reviews. A review that breaks the law or Hauspot's rules can be reported to the Operator at kontakt@hauspot.pl; the Operator will consider the report and may hide the review.
- The Business may not publish reviews of its own Venue or commission others to publish them.
§9. Hiding of a Venue by the Operator
- The Operator may hide a Venue when:
- the Venue's information is untrue or out of date and the Business does not correct it;
- the Venue has closed;
- the Business breaches these Terms or the law.
- The Operator informs the Business that the Venue has been hidden and why. Only the Operator can restore a hidden Venue - the Business gets in touch about it by email.
§10. Fees
- During testing, using the Panel and showing Venues in Hauspot is free of charge.
- The Operator will inform the Business by email at least 30 days before introducing fees. Fees will apply once the new Terms are accepted; without accepting them, the Business may withdraw its Venues or delete its Business Account.
§11. Liability
- Hauspot is in testing. The Operator makes every effort to keep it running, but interruptions and errors may occur, in particular during technical work.
- The Operator is not responsible for content uploaded by the Business or for Users' reviews.
- The Operator does not guarantee any number of views, visits or guests.
- The Operator's liability to the Business is limited to damage caused intentionally [to be specified].
§12. Personal data
The rules for processing personal data are set out in the Privacy Policy.
§13. Complaints
- Complaints about the Panel or Hauspot can be sent to kontakt@hauspot.pl.
- The Operator replies to a complaint within 14 days.
§14. Changes to these Terms
- The Operator may change these Terms, in particular as Hauspot develops or the law changes.
- The Operator informs the Business of changes by email, and the new version must be accepted at the next sign-in to the Panel.
- Until it is accepted, the Business cannot use the Panel. It may delete its Business Account instead.
§15. Final provisions
- These Terms are governed by Polish law.
- Disputes are settled by the court competent for the Operator's registered office [to be specified].
- For sole traders for whom the agreement is not of a professional nature, consumer protection provisions apply to the extent provided by law (Article 385⁵ of the Polish Civil Code).
